The civil law of the land is very hard to understand for many people. There are so many different types of legal loopholes and such that must be considered that a person needs to fully understand the concepts before they attempt to rush a judgment.
However, you have the right to collect what has been given to you and in doing so you are going to be able to target the entire legal system with this opportunity.
In many civil cases there is a monetary settlement in order. This means that you have won money from a lawsuit and in doing so you are entitled to collect.
However, that is much harder to do then you would think. You have to understand that using the legal system is going to be something that is hard to swallow because you have to follow all the legal guidelines. A lawyer may be needed.
However, if you are entitled to a judgment then you can be sure that you are getting it. This means that you are going to be able to get all that you need and then some. But the real issue is actually spending the right amount of time in the collection issue.
So you have to be sure that you are getting the best legal advice that you can on the issue of the settlement. If you do so then you will be ahead.
That is where we are going to look at the idea of the settlement and all the things that can happen to be sure that you are getting your money.
This can be a long and drawn out process and as such you have to be prepared for the enduring run. You should not plan on spending the money until you have gone through the entire process. It may take years for you to ever see a dime of what is owed to you.
Garnishment This is a common practice in the civil legal system where the money that is owed is directly taken from a person's paycheck each week. The law only allows the court to take a certain percentage, usually about twenty five percent, and the rest has to be left alone.
As such you will be waiting for a long time to actually get the money that is coming to you but in fact you will be getting in a guaranteed way.
Attachments The court can also attach property. This is where a hold is placed on all property that the person has and they cannot sell it without first paying off the debt that is owed through the courts.
So if the person does sell the item then you would be paid first to cover the settlement and the remaining balance would then be sent to the seller. This is also a long time in coming but it can be much easier to handle.
Estate Finally the court can make lien against the estate of the person. Basically what is being said is the fact that the amount of money left behind by the deceased person is dispersed to the
debts first before any heirs get it.
