There is going to be a time when you are working with things in the right way and then all of a sudden something happens. You may find yourself in the court room trying to get money from someone that is not paying you. This is something that is very common in this world.

People the world over are going through the small claims process and continue to do so all the time. This is considered the one way that people are going to be able to get their money.

However, if you are not careful then you are going to have to deal with things in the right way. Over all this is something that can be placed in the process of taking people to court to get what is coming to you.

If you want to do that then you are going to have to know what you are doing. All in all you have to make sure that you are getting the best over all situation in hand and then you can make the change that is going to help you challenge the entire deal.

We have to make the change and then continue from there to be sure of what is going on.  The process of small claims is very simple for the most part. You have to be sure that the amount that is owed is under ten thousand dollars and that you are the one that the money is owed too.

As long as you have all things in order then you are going to be fine. It will cost you the amount of the filing fee to get the ball rolling. This can be something as small as twenty five dollars and as much as three hundred depending on where you live.

However, the cost of the fee will be returned to you should you win the judgment. Now then, the court will send the statement to the person that you are suing saying that they must appear in court and show why they do not owe this money.

On the day of court the judge will hear the evidence from both parties and make a ruling. If the ruling is in your favor then you are going to get the money that is coming to you.

However, you have to be sure that you know what is coming. In most of the states of the US there is no way for the judge to punish the person for not paying. So even if they do not pay then you are going to have very little in the way of recourse.

The judge may issue an order that takes the money directly from the paycheck of the person, this is known as garnishment. But if the person does not have a job then you are most likely not going to see anything. However, the order will stay in force forever.

If the person were to get a job then you would have a recourse to claim some of the money. Furthermore, you could have a claim against the estate of the person as well. If they die and have an estate that has value then you would be one of the people that would get the money from it.
